⚠️  Interim Platform Notice — Pre-Launch Concierge Period

Currently operating in Concierge Mode

JobsU is currently in an initial pre-launch period ("Concierge Period") during which the founder personally facilitates service matches between Residents and Students. This notice supplements the main Terms of Service below and, where it conflicts, takes precedence for the duration of the Concierge Period. JobsU will notify users when the Concierge Period ends and full platform operations begin.

During the Concierge Period, JobsU facilitates introductions between Residents and Students through direct communication rather than automated platform features. JobsU's role remains that of a marketplace facilitator connecting independent parties. JobsU does not employ, supervise, or direct Students in the performance of their work, and no employment, agency, or staffing relationship is created by the facilitation of these introductions.

All terms in Sections 2, 4, 5, 6, 7, 8, 17, and 18 remain in full force and effect during the Concierge Period.

During the Concierge Period, payments are processed through the JobsU business payment account (currently Venmo, reachable at info@jobsu.app) rather than through Stripe. The automated payment hold, pre-authorization, and connected account mechanics described in Section 9 are not yet operational.

During the Concierge Period, communications between JobsU, Residents, and Students may occur via email, text message, or other direct channels rather than exclusively through in-app messaging. The off-platform communication restrictions in Section 12 apply to arrangements between Residents and Students but do not restrict communications between either party and JobsU during this period.

When JobsU transitions to full platform operations — including automated matching and Stripe payment processing — JobsU will notify all active users. At that time, this Interim Platform Notice will be retired, the main Terms of Service will govern in full, and any features described in the main Terms that were not yet operational during the Concierge Period will take effect.

Welcome to JobsU. These Terms of Service ("Terms") govern your access to and use of the JobsU platform, including the JobsU mobile application, website, and all related services (collectively, the "Platform"). Please read these Terms carefully before using JobsU.

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.

1. Overview of the Platform

JobsU is an online marketplace that connects individuals seeking short-term services ("Residents" or "Job Posters") with .edu-confirmed college students offering services ("Students" or "Service Providers"). Examples of permitted services include babysitting assistance, tutoring, yard work, errands, light moving assistance, pet care, and other task-based work, subject to the limitations set forth in these Terms.

JobsU IS NOT: an employer, staffing agency, labor contractor, party to any service agreement between users, guarantor of any services, or provider of any insurance coverage. Service Providers are independent contractors who control how they perform their work. JobsU acts solely as a technology platform facilitating introductions and payments between users.

2. Independent Contractor Relationship

Service Providers using JobsU are independent contractors. Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship between JobsU and any user.

To create an account and use the Platform, you must:

Student Verification: Students must verify their enrollment status using a valid .edu email address issued by an accredited institution. JobsU reserves the right to periodically re-verify enrollment status and to suspend accounts where verification cannot be confirmed.

You are responsible for all activity that occurs under your account. If you suspect unauthorized access, you must notify JobsU immediately at support@jobsu.app.

4. Service Agreements Between Users

All service agreements are made directly between Residents and Service Providers. JobsU is not a party to, and bears no responsibility for, any agreement, arrangement, or dispute between users.

JobsU does not guarantee:

Users assume all risks associated with interactions, communications, and transactions arranged through the Platform. You agree to exercise your own independent judgment and due diligence when engaging with other users.

Property Access and Damage: Residents who permit Service Providers to enter or perform work on their property do so at their own risk. Residents are strongly encouraged to confirm that their homeowner's, renter's, or liability insurance policy provides appropriate coverage for third parties performing work on their property, including coverage for bodily injury and property damage. Service Providers are strongly encouraged to carry their own general liability insurance appropriate to the services they offer. JobsU is not responsible for any property damage, loss, or theft occurring before, during, or after the performance of services.

5. Prohibited Job Types and Service Limitations

The Platform is intended only for non-specialized, task-based work that does not require a professional license, specialized training, or regulated certification. To protect all users, the following categories of work are strictly prohibited on the Platform, whether posted by Residents or offered by Service Providers:

JobsU reserves the right, in its sole discretion, to remove job postings, suspend accounts, and permanently terminate users who post or accept work in any prohibited category. This list is non-exhaustive, and JobsU may update it at any time to reflect additional prohibited categories.

6. Babysitting and Childcare Assistance

Babysitting services offered through the Platform are provided on a non-licensed, informal basis. Service Providers offering babysitting assistance are college students, not licensed childcare providers, licensed daycare operators, or medical professionals.

Parental and Guardian Responsibility: Parents and legal guardians remain at all times solely and ultimately responsible for the safety, supervision, medical care, and well-being of their children. Service Providers serve only as temporary aids at the direction of the parent or guardian. Parents and guardians are responsible for providing Service Providers with any emergency contacts, medical information, allergy information, house rules, and instructions necessary to care for their children.

No Certification Guarantee: JobsU does not require Service Providers to hold CPR certification, first aid certification, early childhood education credentials, or any other childcare-related qualification. Any certifications listed on a Service Provider's profile are self-reported and have not been independently verified by JobsU unless expressly stated otherwise. Residents are solely responsible for verifying any certifications that are material to their hiring decision.

By booking babysitting assistance through the Platform, Residents acknowledge and accept these limitations and agree that JobsU bears no responsibility for any injury, illness, incident, or harm arising out of or related to such services.

7. Moving Assistance and Physical Labor

Moving assistance, furniture rearrangement, lifting, and similar physical tasks carry inherent risks of bodily injury and property damage. By posting or accepting any such job, both Residents and Service Providers acknowledge and accept the following:

JobsU is not responsible for any injury, damage, loss, or theft arising out of or related to moving assistance or physical labor performed through the Platform.

8. Insurance Disclaimer

No Insurance Provided by JobsU. JobsU does not provide, offer, or arrange insurance coverage of any kind for Residents, Service Providers, or any other party in connection with services arranged through the Platform. JobsU does not carry general liability, professional liability, workers' compensation, property, or any other insurance for the benefit of its users.

No Insurance Requirement. Neither Residents nor Service Providers are required by JobsU to carry insurance in order to use the Platform. However, both parties are strongly encouraged to evaluate their own insurance needs and to obtain coverage appropriate to the services they intend to perform or receive.

Assumption of Risk. Both Residents and Service Providers assume full and complete risk for any property damage, bodily injury, illness, death, financial loss, theft, or other harm arising out of, related to, or in connection with any services arranged, performed, or received through the Platform. Each party agrees that it is their sole responsibility to assess and insure against such risks, and that JobsU shall have no liability whatsoever for any such losses.

Recommended Coverage. Residents are encouraged to maintain homeowner's or renter's insurance that covers third parties performing work on their property. Service Providers are encouraged to consider general liability insurance, personal accident coverage, and any profession-specific coverage appropriate to the services they offer. Consultation with a licensed insurance professional is strongly recommended.

9. Payments and Payment Holds

Payments for services are processed through Stripe, Inc., JobsU's third-party payment processor. When a Resident books a job, payment is pre-authorized and held pending job completion — this is a pre-authorized payment hold, not a legal escrow arrangement. Funds are released to the Service Provider upon confirmation of job completion by the Resident, or automatically after a defined review period.

By using the Platform:

Fraud Holds: JobsU reserves the right to issue a hold on amounts otherwise payable to a Service Provider if there is reasonable suspicion of fraudulent activity involving their account or for other compelling reasons involving protection of JobsU, the JobsU community, or third-party rights. JobsU may also recommend that Stripe or other third-party payment processors restrict a user's access to funds under such circumstances.

Authorization to Charge: By providing a payment method, you authorize JobsU to charge your payment method for all fees incurred on the Platform as they become due. If your primary payment method is expired, invalid, or cannot be charged, you authorize JobsU to charge any alternative payment method on file with your account. You are responsible for maintaining current and accurate payment information. If JobsU cannot collect fees when due because your payment information is invalid, neither JobsU nor the Service Provider will be responsible for any resulting failure to complete or deliver services.

Non-Refundable Fees: Except as expressly provided in these Terms (including the dispute and cancellation provisions in Section 10), all fees paid through the Platform are non-refundable once paid.

Stripe Connected Account Authorization: You authorize JobsU to obtain all necessary access to, and perform all necessary activity on, your Stripe Connected Account as needed to facilitate payment processing in connection with services arranged through the Platform, including requesting refunds where appropriate. You agree to provide accurate and complete information about yourself and authorize JobsU to share it with Stripe for payment processing purposes. JobsU reserves the right to switch payment processors or use backup vendors at its discretion.

JobsU is not a bank or financial institution. Payment processing and holding services are provided by Stripe, Inc. under Stripe's terms of service.

10. Cancellations, Refunds, and Disputes

Cancellation by Residents: Residents may cancel a job posting before a Service Provider has been confirmed at no charge. Cancellations after confirmation may be subject to a cancellation fee as disclosed at the time of booking. If a job is cancelled before completion, any pre-authorized hold on the Resident's payment method will be released, subject to any applicable cancellation fee.

Cancellation by Service Providers: Service Providers who cancel confirmed jobs may be subject to account penalties, reduced visibility, or account suspension, depending on the frequency and timing of cancellations. JobsU operates a tracked no-show and cancellation strike system; repeated no-shows or late cancellations will result in escalating penalties up to and including permanent account suspension.

Refunds: Refund eligibility depends on the timing and status of the job. JobsU reserves the right, in its sole discretion, to issue full or partial refunds, or to mediate payment disputes between users in order to maintain platform integrity and fairness.

Disputes: Users are encouraged to resolve disputes directly. If a resolution cannot be reached, either party may submit a dispute to JobsU through the Platform. JobsU may, but is not obligated to, mediate disputes and make final determinations regarding payment release.

11. Taxes

Service Providers are solely responsible for reporting and paying all applicable federal, state, and local taxes on income earned through the Platform. JobsU does not withhold taxes on behalf of Service Providers.

Where required by law, JobsU will issue applicable tax documentation, including IRS Form 1099-NEC, to Service Providers who meet the applicable reporting thresholds. Service Providers are encouraged to consult a qualified tax professional regarding their tax obligations.

12. Platform Integrity — Off-Platform Payment Prohibited

All payments and substantive communications must occur through the JobsU platform. Users who circumvent the platform will face immediate and permanent account termination.

13. User Conduct and Prohibited Activities

All users agree to use the Platform in a lawful, respectful, and professional manner. The following conduct is strictly prohibited:

JobsU reserves the right to investigate violations, suspend or permanently terminate accounts, and report illegal activity to law enforcement as deemed appropriate.

14. Ratings and Reviews

After each completed job, both Residents and Service Providers may leave ratings and reviews. Ratings and reviews must be honest, accurate, and based on genuine experiences.

JobsU reserves the right to remove reviews that violate these Terms, contain offensive or defamatory content, or appear to be fraudulent or manipulated. JobsU does not guarantee the accuracy of any ratings or reviews and is not responsible for decisions made based on them.

15. Background Checks and Verification

JobsU may perform identity verification, educational enrollment checks, or other eligibility screening. However, JobsU does not guarantee the accuracy, completeness, or reliability of any verification process.

Important: Verification measures are provided as a supplemental trust layer and do not constitute a guarantee of any user's character, conduct, fitness, skill, or qualifications. Users remain solely responsible for exercising independent judgment and due diligence when engaging with other users on the Platform.

JobsU's exercise of any discretion in selecting, admitting, curating, or onboarding users to the Platform — regardless of how such discretion is described in marketing or promotional materials — does not create any duty of care, warranty of fitness, or guarantee of suitability with respect to any user. The fact that JobsU exercises judgment in admitting users does not render JobsU liable for the subsequent acts, omissions, conduct, or negligence of any user. Residents are solely responsible for independently evaluating the fitness and suitability of any Service Provider before permitting them to perform services or enter their property.

16. Intellectual Property

All content, features, functionality, trademarks, logos, and intellectual property associated with the Platform are owned by or licensed to JobsU, Inc. and are protected by applicable intellectual property laws.

Users may not copy, modify, distribute, sell, or lease any part of the Platform or its content without prior written permission from JobsU. Users retain ownership of content they submit to the Platform but grant JobsU a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with the operation of the Platform.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOBSU, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: ACTS OR OMISSIONS OF ANY USER; PERSONAL INJURY, ILLNESS, OR PROPERTY DAMAGE ARISING FROM SERVICES ARRANGED THROUGH THE PLATFORM; THEFT OR LOSS OF PROPERTY; LOSS OF DATA, REVENUE, OR PROFITS; OR UNAUTHORIZED ACCESS TO YOUR TRANSMISSIONS OR DATA.
IN NO EVENT SHALL JOBSU'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT OF FEES PAID BY YOU TO JOBSU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
USE OF THE PLATFORM IS AT YOUR OWN RISK. THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. JOBSU EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IF YOU HAVE A DISPUTE WITH ANOTHER USER — WHETHER A RESIDENT OR A SERVICE PROVIDER — YOU AGREE TO RELEASE JOBSU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES FROM ALL CLAIMS, DEMANDS, AND DAMAGES OF EVERY NATURE, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTE. IN NO EVENT WILL JOBSU BE LIABLE FOR ANY DIRECT OR INDIRECT CONSEQUENCES OF A RESIDENT OR SERVICE PROVIDER FAILING TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS. CALIFORNIA RESIDENTS EXPRESSLY WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY." RESIDENTS OF OTHER JURISDICTIONS WAIVE ANY SIMILAR PROVISIONS OF THEIR RESPECTIVE LAWS.
JOBSU SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMANCE DUE TO CAUSES BEYOND ITS REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, NATURAL DISASTERS, WAR, TERRORISM, PANDEMICS, GOVERNMENT ACTIONS, OR INTERNET OR NETWORK FAILURES (FORCE MAJEURE).

18. Indemnification

You agree to indemnify, defend, and hold harmless JobsU, Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

JobsU reserves the right to assume exclusive defense and control of any matter subject to indemnification under this section, at its own expense. You agree to cooperate with JobsU in the defense of any such claims and will not settle any claim or matter covered by this indemnification without JobsU's prior written consent.

19. Dispute Resolution and Arbitration

Informal Resolution: Before initiating any formal dispute, you agree to first contact JobsU at support@jobsu.app and attempt to resolve the matter informally for at least thirty (30) days.

Binding Arbitration: If informal resolution is unsuccessful, any disputes arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any disputes will be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding.

Small Claims Exception: Either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits.

Arbitration Opt-Out: You may opt out of the binding arbitration agreement in this section by sending written notice to legal@jobsu.app within thirty (30) days of first accepting these Terms. Your notice must include your name, account email address, and a clear statement that you wish to opt out of arbitration. If you opt out, all disputes will be resolved exclusively in the state or federal courts located in Delaware as provided in Section 24.

20. Account Suspension or Termination

JobsU may, at its sole discretion, suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to:

Upon termination, your right to use the Platform ceases immediately. Any pending payment holds will be handled in accordance with JobsU's then-current policies.

21. Third-Party Services

The Platform may utilize third-party services, including payment processors, identity verification providers, and communication tools. JobsU is not responsible for the availability, accuracy, or performance of any third-party service and disclaims all liability for third-party service interruptions, errors, or failures.

Your use of third-party services may be subject to additional terms and conditions imposed by those providers.

22. Communications and Notifications

By creating an account, you consent to receive communications from JobsU, including transactional emails, push notifications, and service-related announcements. You may opt out of non-essential communications at any time through your account settings, but you may not opt out of essential service communications (e.g., payment confirmations, security alerts, and Terms updates).

23. Modifications to These Terms

JobsU reserves the right to modify these Terms at any time. We will notify users of material changes by posting updated Terms on the Platform and, where practicable, sending notice via email or in-app notification.

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree to updated Terms, you must discontinue your use of the Platform and close your account.

24. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Subject to the arbitration provisions in Section 19, any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

25. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

26. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and JobsU with respect to your use of the Platform and supersede all prior agreements, understandings, and communications, whether written or oral.
